Kiraify Tech User Service Agreement

Special Notice:

Before using any of the services provided by Kiraify Tech, you should carefully read and comply with the Kiraify Tech User Service Agreement (hereinafter referred to as "this Agreement"). Please read prudently and fully understand the contents of each clause, especially the clauses that exempt or limit liability and the dispute resolution clauses. Clauses that exempt or limit liability may be displayed in bold font and you should read them with particular attention. If you have any questions about this Agreement, please consult Kiraify Tech customer service.

When you fill in the information as prompted on the login page, read and agree to this Agreement, and complete all login procedures, or when you actually use Kiraify Tech's services in any other manner permitted by Kiraify Tech, it means that you have fully read, understood and accepted all the contents of this Agreement and have entered into an agreement with Kiraify Tech. You undertake to accept and comply with the provisions of this Agreement, and you shall not claim that this Agreement is invalid or request its rescission on the grounds that you have not read the contents of this Agreement or have not received answers from Kiraify Tech to your inquiries.

I. Purpose and Scope of the Agreement

1.1 This Agreement is entered into by you and the operator of Kiraify Tech. The latter refers to Hangzhou Qixiao Technology Co., Ltd., collectively referred to as "Kiraify Tech" in this Agreement.

1.2 This Agreement includes the main text of the agreement, various official information published by Kiraify Tech, business handling rules, legal statements, announcements or notices, etc. The above documents constitute an integral part of this Agreement, have the same legal effect, and the documents are mutually interpretive, hereinafter collectively referred to as this Agreement.

1.3 Kiraify Tech aims to provide you with official information release, service information inquiry and business handling services on behalf of Kiraify Tech, and has certain online trading platform functions. Unless otherwise stated in a separate document, all the above services provided by Kiraify Tech are governed by this Agreement. When you use any service provided by Kiraify Tech, it means that you accept all the terms of this Agreement.

1.4 Kiraify Tech has the right to modify the contents of the constituent documents of this Agreement from time to time as needed, or to add new content, without separate notice to you. The amended agreement shall take effect immediately upon publication on the website, or at a specific time specified in the document. Your act of accepting services through Kiraify Tech is governed by the content of the agreement in effect at the time you accept the services. This Agreement is a principled agreement on the rights and obligations of both parties. When you use Kiraify Tech's web pages or application services, you should also comply with the specific agreements and terms at the time of handling the business, and the various agreements at the time of handling shall prevail. If the various official information, business handling rules, legal statements, announcements or notices published by Kiraify Tech are inconsistent with the content at the time of actually handling the business, you should make explicit consultation and inquiry, and the various agreements and business handling rules at the time of actually handling the business shall prevail.

II. Subject Qualification, Account Password and User Information

Subject Qualification

2.1 You confirm that when you log in or actually use Kiraify Tech's services in any other manner permitted by Kiraify Tech, you should be a natural person, legal person or other organization with full civil capacity. If you do not have the foregoing subject qualification, you and your guardian shall bear all consequences arising therefrom, and Kiraify Tech has the right to cancel or permanently freeze your account and claim corresponding losses from you and your guardian.

Account and Password

2.2 Your account and password on Kiraify Tech are your important personal data. To protect the security of your personal data, access requires correct verification through your service password. You need to remember your own service password and must pay attention to the confidentiality of your account and password.

2.3 Kiraify Tech provides you with a variety of login methods, including but not limited to mobile phone number verification login, password login, and QR code scanning login. When using certain platforms, such as Kiraify Tech enterprise services, you may also register user information separately, set a username and password, and log in using that username and password.

2.4 You should set and keep your self-set password on a confidential basis, avoid using information obviously related to yourself such as name, birthday, or telephone number, or overly simple number combinations (such as 12345678, six 6s, eight 8s, etc.) as your password, and should not provide your self-set password to anyone other than those required by law.

2.5 Kiraify Tech provides convenient business handling and service functions. After your first login, the login status will be remembered by default. If you do not change terminals or cancel your account, subsequent use is equivalent to having passed login verification on this device with this account.

2.6 You should take reasonable measures to prevent your password from being stolen and to prevent others from using your terminal (including but not limited to mobile phones) without authorization. You shall bear the consequences caused by password disclosure or unauthorized use by others.

2.7 All business handled through logging in to Kiraify Tech with the account and password shall be deemed to be handled by you personally, and you shall be responsible for all activities that occur under that username and password (including but not limited to publishing information, querying information, clicking to agree or submit, concluding agreements online, purchasing goods or services online, etc.).

2.8 Kiraify Tech has corresponding security measures to protect your transaction security, but Kiraify Tech does not guarantee its absolute security.

2.9 Your login username, nickname (if any) and password may not be sold, transferred, gifted or inherited in any way, unless expressly provided by law or judicial ruling, recognized by Kiraify Tech, and qualified documents required by Kiraify Tech are provided and handled in accordance with Kiraify Tech's operating procedures.

2.10 If you discover that anyone is using your username and password to log in to Kiraify Tech without your authorization, you should immediately notify Kiraify Tech to prevent your losses or adverse effects from further expanding. If you have completed operations on Kiraify Tech using your username and password, when leaving, you should log out in the correct steps. Kiraify Tech will not be responsible for any losses arising from your failure to comply with this provision. You understand that Kiraify Tech needs a reasonable time to take action on your request, and Kiraify Tech shall not be liable for consequences that have already occurred before taking action (including but not limited to any of your losses and adverse effects).

2.11 You guarantee that you will not use the services provided by Kiraify Tech to publish any information that violates legal provisions and Kiraify Tech's management rules, and will not commit acts that infringe upon the lawful rights and interests of others or violate legal provisions and Kiraify Tech's management rules. If any of the above acts occurs, Kiraify Tech has the right to take necessary measures including but not limited to canceling your username, deleting or blocking the information you published, and terminating the provision of services to you.

2.12 When using the services provided by Kiraify Tech or conducting transactions, you should fill in your relevant information as prompted on the corresponding page and update it in a timely manner when the relevant information changes. You guarantee the authenticity, completeness, accuracy and timeliness of the information you provide. If your information cannot meet the above requirements, you shall bear the adverse consequences arising therefrom, which may also cause Kiraify Tech to suspend or terminate the provision of services to you.

User Information:

2.16 You should accurately fill in and promptly update your contact information such as email address, contact telephone number, contact address, and postal code, so that Kiraify Tech or other users can effectively contact you. If you cannot be contacted through the contact information you provided, resulting in any losses or increased costs during your use of Kiraify Tech services, you shall bear them alone.

III. Kiraify Tech Service Content, Services and Usage Rules

Service Content:

3.1 Kiraify Tech mainly provides you with official information release, service information inquiry, and business handling on behalf of Kiraify Tech, and has certain online trading platform functions. Through the online trading platform, you can query product information, reach transaction intentions and conduct transactions.

3.2 The product and service information in the Kiraify Tech online trading platform is published by Kiraify Tech or the corresponding settled merchants. When purchasing products, please identify your transaction counterparty, which shall bear the legal liability as an operator to you in accordance with the Law on the Protection of Consumer Rights and Interests, the Product Quality Law and other legal provisions, as well as the product information and transaction rules it publishes.

3.3 When your transaction counterparty is a third-party settled merchant, Kiraify Tech will assist in providing you with the merchant's relevant contact information. If a dispute arises from a transaction you conduct using the Kiraify Tech online trading platform, it shall be resolved by you and your transaction counterparty through negotiation or legal channels.

3.4 Kiraify Tech will take corresponding security measures to protect your transaction security, but you understand that Kiraify Tech shall not be liable for online transaction risks caused by non-website reasons such as network transmission, computer viruses, and hacker intrusions.

? Service Rules:

3.5 Before applying to handle business, applying to query information, or any other services provided by the website, please be sure to read in detail the various relevant business rules published on the website, and submit the business handling application only after ensuring complete understanding. If you do not understand the business rules published on the website, please be sure to consult Kiraify Tech before submitting the business handling application. The business application you submit to Kiraify Tech constitutes your offer.

3.6 You understand and agree that:

3.6.1 If you violate the foregoing agreements and undertakings, you shall bear all legal consequences alone, and you shall bear any losses caused to Kiraify Tech or any expenses incurred thereby.

3.6.2 For the needs of maintaining the normal operation of Kiraify Tech, normal transaction order and transaction security, Kiraify Tech has the right to take measures to close the corresponding transaction orders and business applications in the event of malicious purchases or any other circumstances that disrupt normal operation or normal transactions.

3.6.3 If you send information containing content that violates the above agreements, Kiraify Tech has the right to take necessary measures including but not limited to deleting or blocking the information, providing your personal information to the victim, and reporting to the relevant law enforcement agencies as needed.

3.7 You need to provide true and accurate personal information, otherwise your business application will not be accepted, or it may cause you to incur additional costs or cause your losses.

3.8 You agree that Kiraify Tech may collect your personal information from logging in to the website for needs related to providing services to you, such as customer service, conducting activities, improving customer experience, completing transactions, and goods delivery, including but not limited to the personal information you fill in, Internet access records, transaction records and other information, except for information related to property security such as login passwords, transaction passwords, and bank account numbers. Kiraify Tech undertakes to keep strictly confidential information involving personal privacy. Except with your authorization, for the performance of mandatory legal obligations (such as explicit orders from national law enforcement agencies) or as otherwise provided by law or agreed by both parties, this website will not disclose your private information to the outside world.

3.9 For all pictures and text information published on Kiraify Tech, without the written permission of Kiraify Tech, you shall not copy or disseminate such pictures and text information for any commercial purpose.

3.10 When you log in to Kiraify Tech, use the services provided by Kiraify Tech, or use Kiraify Tech to conduct transactions, you agree to comply with the following agreements:

3.10.1 All acts performed comply with legal provisions and the provisions of this Agreement, do not violate public order and good customs or social public morality, do not harm social public interests, and do not harm the lawful rights and interests of the state or any third party.

3.10.2 If you publish relevant information through Kiraify Tech, the content of the information you send shall not contain any of the following:

① Harassing, defamatory, abusive, intimidating, harmful, provocative, vulgar, or obscene content;

② Content that instigates others to commit criminal acts;

③ Content involving national security or state secrets;

④ Content that infringes upon any lawful rights and interests of others;

⑤ False and untrue information, including false and untrue review information about products sold on the trading platform;

⑥ Content that violates social public order and good customs, public morality or public interests;

⑦ Information that is illegal under any legal provision.

3.10.3 Not using any device or software to interfere or attempt to interfere with the normal operation of Kiraify Tech, or to interfere with any transactions and usage activities on Kiraify Tech. You undertake not to use any device or act that may cause Kiraify Tech's operating equipment to bear an unreasonably huge data load.

3.10.4 Any other act that violates the provisions of this Agreement and violates legal provisions.

IV. Kiraify Tech Product Sales

Definition of Kiraify Tech Product Sales

4.1 Kiraify Tech products include but are not limited to game card packs and value-added services.

4.2 Product sales order fulfillment refers to the execution process after a product order is placed, including but not limited to delivery to the door or customer self-pickup, order package handover, and activation of the business involved in the product. The specific methods and requirements for fulfilling Kiraify Tech product sales and services (hereinafter referred to as "Electronic Services") published by Kiraify Tech shall prevail.

Execution and Performance of Electronic Service Agreement

4.3 You should select suitable products according to Kiraify Tech's prompts and undergo necessary identity information verification. You should clearly understand the relevant content of the product before placing an order. After successfully placing an order, you cannot use lack of understanding of the product or service as a reason for not performing the order.

4.4 You should, after confirming the selected products, carefully read the relevant content of this Agreement displayed by Kiraify Tech through Kiraify Tech, and perform relevant operations according to Kiraify Tech's prompts after agreeing. Once the operation is completed, it is deemed that you fully understand and accept all the terms of this Agreement.

4.5 You should, according to Kiraify Tech's prompts, select a suitable method of fulfilling the Electronic Services (including but not limited to delivery to the door, etc., subject to the information published by Kiraify Tech), complete the filling in of relevant information, and ensure the authenticity of the information.

4.6 Except for force majeure, after successfully placing an order, both parties should complete order fulfillment in accordance with the Electronic Services fulfillment methods and requirements published by Kiraify Tech. When fulfilling an order, you need to provide your own true and valid identity document (limited to ID card).

Fees and Payment of Fees

4.7 The content, services, and products from third-party websites and APPs displayed by Kiraify Tech, as well as other content (such as advertisements) linked or pointed to by such content, which are not Kiraify Tech's own service content, do not represent Kiraify Tech's views. If you need to conduct transactions in such services or products, you should carefully discern the accuracy and security of such content. If you are not sure whether such content is accurate and safe, Kiraify Tech recommends that you consult professionals first. Fee disputes arising from the purchase of third-party products and services (including failure to receive goods after payment, etc.) need to be resolved by you with the third-party website or APP through negotiation or legal channels.

V. Other Provisions

5.1 All software, hardware and other costs and expenses incurred by you in the course of using Kiraify Tech services shall be borne by you alone.

5.2 The product picture displays, descriptions and prices on Kiraify Tech do not constitute an offer. If you order products through Kiraify Tech, your order becomes an offer to purchase products. Your purchase contract is only formed when we receive your purchase application, review it and send you a confirmation SMS or other form of notification.

5.3 Kiraify Tech strives to make all kinds of business information, product information, and business rules as accurate as possible, but we do not guarantee the accuracy, completeness, or timeliness of such information. If the product you purchased through Kiraify Tech itself is inconsistent with Kiraify Tech's information, you may return the unused product to the corresponding merchant and request the merchant to perform its statutory or agreed obligations in other forms in accordance with the law.

5.4 Kiraify Tech does not guarantee that Kiraify Tech's services will necessarily meet customer requirements, does not guarantee that services will not be interrupted, does not guarantee that services are absolutely timely, secure, true and error-free, nor does it guarantee that information sent by customers can be transmitted completely accurately, timely and smoothly, but it will do its utmost to ensure the timely provision of services and provide customers with convenient and fast services.

5.5 Under no circumstances shall Kiraify Tech be liable for any indirect, incidental, special or consequential losses, damages, debts or business interruptions caused by the use of or inability to use the services provided by Kiraify Tech.

5.6 The formation, effectiveness, performance and interpretation of this Agreement shall be governed by the laws of the People's Republic of China.

5.7 In the course of performing this Agreement, any dispute arising shall be resolved by both parties through friendly negotiation. If negotiation fails, it shall be submitted to the people's court at the location of Hangzhou Qixiao Technology Co., Ltd. for litigation.

5.8 If any entity or individual believes that third-party content displayed by Kiraify Tech may be suspected of infringing their lawful copyright, they should promptly report it to Kiraify Tech in writing and provide relevant supporting materials. After receiving the above documents, Kiraify Tech will disconnect the relevant links as soon as possible. If there is any objection, both parties should resolve it through relevant legal channels and bear the relevant legal liability. For third-party content infringement incidents, the third-party provider shall bear the corresponding legal liability, and Kiraify Tech shall not be responsible, nor can it bear any legal liability.
